Supreme Court to Decide Whether to Review Appellate Decision Finding Cell Phone Radiation Claims Preempted
This week, the United States Supreme Court will consider whether to grant a petition for certiorari to review the October 2010 decision by the U.S. Court of Appeals for the Third Circuit holding that federal telecommunications regulations preempted a state law tort action claiming damages based on the radio frequency (“RF”) radiation emitted by cell phones.
